The Kansas City office at 415 E. 12th Street, 9th Floor serves residents on the western side of the county. Both locations share the same phone line at (816) 881-3755. Cases can be filed at either location. If you live in Independence or the east part of the county, the 308 W. Kansas St. office is the more convenient choice.
Independence was the original county seat of Jackson County. The Missouri State Archives holds Jackson County probate records from 1820 through 1955 on microfilm, covering the county's earliest estate and guardianship cases from when Independence served as the administrative center.

Note: Independence Municipal Court at 111 E. Maple Ave., (816) 325-7111, handles city violations only and is not the place to file or look up probate records.
How to Search Independence Probate Records
Missouri's Case.net portal is the main online tool for searching Jackson County and Independence probate records. It is free, requires no account, and is available at courts.mo.gov/casenet. For a quick check on case status or basic filing information, Case.net is the fastest option.
Enter the person's name in the format "LAST, FIRST MIDDLE INITIAL" exactly as shown. The search is literal. Reversing the name order returns no results. For common names, filter by Jackson County to narrow the results. Case.net shows case parties, docket entries, hearing dates, and judgment records. It does not show the full text of documents filed with the court. Jackson County also has a separate probate records website for some older cases, accessible through the 16th Circuit's online resources.
Since July 1, 2023, public court documents filed on or after that date can be viewed and downloaded from a personal device through Case.net. Documents filed before that date are available only at courthouse terminals. For Independence-area residents, the terminals at the W. Kansas St. office give access to older case records. Bring a photo ID and any case identifying information when you visit during business hours.

Types of Probate Cases in Independence
The Jackson County Probate Division handles the same core probate case types at both its Independence and Kansas City locations. Cases are part of the same county-wide system and are searchable through Case.net regardless of which office processed the filing.
Estate administration is the most common type. When an Independence resident dies with assets held in their name, those assets often need probate to transfer to heirs. A will, if one exists, must be filed with the court. The court appoints a personal representative to manage and close the estate. Chapter 473 RSMo governs this process. The six-month creditor period runs from the date of the first published notice. Personal representatives must file annual account statements on the anniversary of their appointment.
Guardianship and conservatorship cases are also handled at the Independence office. These arise when a person cannot manage their own personal or financial decisions, whether due to age, disability, or incapacity. Under Chapter 475 RSMo, any adult respondent in a guardianship or conservatorship case must have a court-appointed attorney. Annual reports are required for all open cases.
The Jackson County court also handles emergency mental health commitments, trust litigation, and will contests. Small estate affidavits under Section 473.097 RSMo are available for estates of $40,000 or less, filed 30 days after death. Estates between $15,000 and $40,000 still need publication under the simplified procedure.

The city site covers the Independence Municipal Court, which handles city ordinance and traffic violations. For probate matters, the relevant court is the Jackson County Circuit Court Probate Division at 308 W. Kansas St., not the municipal court. Knowing this distinction saves time when you are looking for a specific type of record or need to file a case.

Probate Filing Fees for Independence Cases
Jackson County's Independence probate office follows Missouri's standard probate fee schedule. Filing a full estate administration petition costs approximately $155.50. The simplified small estate affidavit process, for estates of $40,000 or less, costs about $65.50 to $75.00.
The small estate process under Section 473.097 RSMo can begin 30 days after death. Estates between $15,000 and $40,000 require publication even under the simplified approach. Estates under $15,000 do not require publication and are the most straightforward to process.

Personal representative compensation follows the statutory schedule at Section 473.153 RSMo: 5% on the first $5,000 of estate value, 4% on the next $20,000, 3% on the next $75,000, 2.75% on the next $300,000, 2.5% on the next $600,000, and 2% on amounts over $1 million.
Missouri Probate Laws That Apply in Independence
All probate cases filed in Independence and Jackson County fall under Missouri's statewide probate code. The four main chapters are at revisor.mo.gov.
Chapter 472 RSMo covers general provisions: definitions, jurisdiction, venue, and record-keeping. Section 472.280 allows records to be kept electronically. Section 472.013 provides a two-year window from discovery to file a fraud claim in a probate proceeding, with an absolute outer limit of ten years for actions against innocent beneficiaries.
Chapter 473 RSMo governs estate administration from petition to final settlement. Personal representatives file annual accounts on the anniversary of their appointment and must complete final settlement within six months and ten days of the first creditor notice publication.
Chapter 474 RSMo sets out intestate succession, covering who inherits when a person dies without a valid will. Spouses and children come first, then parents and siblings, and so on through more distant relatives.
Chapter 475 RSMo governs guardianship and conservatorship. It requires court-appointed attorneys for adult respondents and mandates annual reporting for all open cases. Missouri Court Operating Rule 2.02 sets the baseline that all court records are presumed public unless a specific exception applies.
Public Access to Independence Probate Records
Missouri Court Operating Rule 2.02 says court records are presumed open to the public. Independence and Jackson County probate records are public records. You do not need to be a party to the case, and no explanation of purpose is required.
Some records are not available. Sealed cases, juvenile records, expunged records, mental health matters, and alcohol or drug-related estate cases in Jackson County are excluded from public access. For open records, the person filing a document is responsible for removing confidential information: Social Security numbers, financial account numbers, driver's license numbers, dates of birth, and names of minors must all be redacted before filing. Earlier records are available only at courthouse terminals. For Independence residents, the terminals at the W. Kansas St. office and the Kansas City 12th Street office both provide access to older Jackson County probate records. Plan to visit during business hours and bring a photo ID.
