Types of Probate Cases for St. Peters Residents
St. Peters residents encounter the same probate case types as anyone else in St. Charles County. All cases are filed at the St. Charles County courthouse and become part of the public record there.
Estate administration is the most common type. When a St. Peters resident dies with assets in their name, an estate case may be needed to transfer property to heirs. If there is a will, it must be filed with the probate division. A personal representative is appointed and given authority to manage and close the estate under Chapter 473 RSMo. Creditors have six months from the first notice publication to file claims.
Smaller estates may qualify for the streamlined small estate procedure. Section 473.097 RSMo allows heirs to use an affidavit for estates of $40,000 or less (after subtracting liens). The affidavit can be filed 30 days after the death. Publication is required if the estate value is between $15,000 and $40,000. The filing fee for this process is lower than for full administration.
Guardianship and conservatorship cases protect people who cannot manage their own personal or financial affairs. These cases arise for both minors and incapacitated adults. Chapter 475 RSMo requires court-appointed attorneys for adult respondents and mandates annual reporting for all active cases.
