Types of Probate Cases in Audrain County

Estate administration cases make up the bulk of the Audrain County probate docket. When a person dies with assets titled in their name alone, those assets typically need to pass through probate before they can be transferred to heirs or beneficiaries. If the person had a will, it must be filed with the court. A personal representative is appointed to manage the estate under Chapter 473 RSMo. Creditors get six months from first publication to file claims. After that period, assets can be distributed and the estate closed.

Guardianship and conservatorship cases are also handled by the Audrain County probate division. Guardianship gives a person legal authority to make decisions for someone who cannot care for themselves, whether that is a minor child or an incapacitated adult. Conservatorship covers financial management. Annual reports are required to keep these cases active. Chapter 475 RSMo governs both types of proceedings and requires court-appointed attorneys for adult respondents. Attorney fees in these cases are taxed as costs to the respondent's estate unless the respondent is found not incapacitated or qualifies for public assistance.

Small estate cases under $40,000 use a simplified affidavit process under Section 473.097 RSMo. This avoids the full probate process and can be filed 30 days after death. Estates between $15,000 and $40,000 still require publication of notice even with the simplified process.

Fees for Audrain County Probate Court Records

Audrain County follows Missouri's standard probate fee schedule. Filing a full estate petition costs approximately $155.50. A small estate affidavit costs about $65.50 to $75.00. Document copies are $0.25 per page. Certified copies carry a higher fee. Confirm current rates with the clerk at (573) 473-5800 before your visit.

Personal representative fees in Audrain County follow the scale in Section 473.153 RSMo: 5% of the first $5,000, 4% of the next $20,000, 3% of the next $75,000, 2.75% of the next $300,000, 2.5% of the next $600,000, and 2% of any amount over $1 million. These percentages apply to the total value of assets managed. The court must approve attorney fees and any extraordinary compensation for the personal representative beyond the statutory schedule.

Note: Fees can change. Always verify current amounts before sending payment to the Audrain County clerk's office.

Missouri Probate Laws for Audrain County Cases

Missouri's probate code applies uniformly to all counties. The statutes are at revisor.mo.gov. For Audrain County cases, the main chapters to know are 472, 473, 474, and 475.

Chapter 472 RSMo establishes general probate rules. Section 472.280 allows records to be kept in electronic formats, supporting Case.net. Section 472.013 provides fraud remedies, with a two-year window from discovery and a ten-year outer limit against innocent beneficiaries. Chapter 473 RSMo covers estate administration step by step. Personal representatives must file annual accounts and wrap up the estate within six months and ten days after the first publication of creditor notice. Chapter 474 RSMo handles intestate succession when no valid will exists. Chapter 475 RSMo covers guardianship and conservatorship, including the requirement for annual reports and court-appointed attorneys.

Public Access to Audrain County Probate Records

Audrain County probate court records are open to the public. Missouri Court Operating Rule 2.02 establishes this presumption of openness for all court records statewide. You can request to view or copy any probate record without providing a reason, and you do not need to be a party to the case.

Exceptions exist. Sealed, expunged, juvenile, and mental health records are not available. For open records, certain personal data must be redacted by the person who filed the document. Social Security numbers, driver's license numbers, financial account numbers, dates of birth, and names of known minors must be removed. The clerk's office does not screen documents for compliance before accepting them, so filers bear full responsibility for proper redaction.
