Types of Probate Cases in Barry County

The Barry County probate division handles several types of cases. Estate administration is the most frequent. When a Barry County resident dies owning property, the estate often needs court oversight to transfer assets legally to heirs. If a will exists, it gets filed with the court. A personal representative is appointed, creditors receive published notice, and assets are eventually distributed under Chapter 473 RSMo. The creditor claim period runs six months from first publication.

Guardianship cases are filed when a person needs someone to make personal decisions for them. This applies to minor children without parents to care for them and to adults who have become incapacitated. Conservatorship cases address financial management for those same individuals. Both types require annual reports to the Barry County court under Chapter 475 RSMo, and the court must appoint an attorney for adult respondents in these proceedings.

Small estate cases use a simplified process available when the estate value is $40,000 or less under Section 473.097 RSMo. A small estate affidavit can be filed 30 days after death. Estates between $15,000 and the threshold require publication of notice before assets can be transferred.

Will contests may also come before the Barry County court. Section 472.013 RSMo gives injured parties two years from discovering fraud to seek relief, with a maximum of ten years against innocent beneficiaries.

Fees for Barry County Probate Court Records

Barry County uses Missouri's standard probate fee schedule. Filing a full estate petition costs approximately $155.50. A small estate affidavit costs about $65.50 to $75.00. Copies are $0.25 per page for standard copies. Certified copies carry a higher rate.

Personal representative fees follow the statutory scale in Section 473.153 RSMo. That means 5% on the first $5,000, 4% on the next $20,000, 3% on the next $75,000, 2.75% on the next $300,000, 2.5% on the next $600,000, and 2% on any amount above $1 million. Attorney fees must be approved by the court. Call (417) 847-3132 to confirm current copy rates and filing fees before submitting anything to the Barry County clerk.
