Cass County probate court information and records guide

This resource provides a quick overview of the Cass County probate court structure and common filing requirements.

Types of Probate Cases in Cass County

Cass County probate court records cover several categories of legal proceedings. Each type results in a separate case file kept at the 17th Judicial Circuit courthouse. Understanding which type applies to your situation helps you search more effectively and know what documents to expect in the file.

Decedent estates are the most common type. When someone dies with property in Cass County, their estate must go through probate if the assets exceed the small estate threshold or are titled solely in the deceased's name. The executor or administrator files a petition with the Circuit Court, which opens the case and assigns a case number. The estate file then includes the petition, the will (if one exists), an inventory of assets, creditor claims, annual accounts, and the final settlement. Under Chapter 473 RSMo, creditors have six months from the first publication to file claims, and final settlement cannot happen until at least six months and ten days after that publication date.

Small estate proceedings offer a faster path. Missouri allows estates valued at $40,000 or less under Section 473.097 RSMo to use a simplified affidavit process rather than full probate. The affidavit can be filed no sooner than 30 days after death. Filing fees run approximately $65.50 to $75.00. If the estate exceeds $15,000, publication notice is required. Small estate files are also part of Cass County probate court records and can be searched through Case.net or at the courthouse.

Guardianship and conservatorship cases are filed under Chapter 475 RSMo. These apply when someone cannot care for themselves due to age, disability, or incapacity. The court appoints a guardian for personal care decisions and a conservator for financial management. Annual reports are required in conservatorship cases. All filings become part of the Cass County probate court record and are accessible to authorized parties. Will contests and petitions challenging the validity of a will are also handled by the 17th Judicial Circuit in Harrisonville.

Cass County Probate Fees and Costs

Probate costs in Cass County follow Missouri's standard fee structure. The full estate filing fee is approximately $155.50. Small estate affidavit fees run from $65.50 to $75.00. Copy fees are $0.25 per page for plain copies; certified copies cost more. Contact the clerk's office at 816-380-8227 to get current rates before filing.

Personal representative fees in Missouri are set by statute at Section 473.153 RSMo. The schedule is: 5% on the first $5,000; 4% on the next $20,000; 3% on the next $75,000; 2.75% on the next $300,000; 2.5% on the next $600,000; and 2% on everything over $1,000,000. Attorneys handling the estate are entitled to the same fee scale. These fees come from the estate assets and are paid before final distribution to heirs. Cass County probate court records will reflect all fee petitions and court approvals as part of the public case file.

Note: Missouri law at Section 472.013 RSMo provides a two-year discovery period and ten-year maximum for fraud-related probate claims. Any such filings become part of the Cass County probate court record.

Public Access to Cass County Probate Records

Probate court records in Cass County are presumed open to the public under Missouri Court Operating Rule 2.02. Most people can walk into the Harrisonville courthouse, give a name or case number to the clerk, and view the file. You do not need to be a party to the case or provide a reason for your request. This applies to wills, inventories, accountings, orders, and final settlements.

That said, certain information is routinely redacted before documents are made fully public. Social Security numbers, driver's license numbers, financial account numbers, dates of birth, and names of minors are protected under Missouri rules. If you receive a document from the clerk and some information is blacked out, this is normal and follows state policy. The core facts of the case, including names of parties, asset values, case outcomes, and court orders, remain accessible.
