Holt County Quick Facts
Holt County Circuit Court Probate Division
In Holt County, probate matters are handled by the Associate Circuit Court, Division II rather than the general Circuit Clerk's office. Division II in Oregon manages decedent's estates, guardianship petitions, and conservatorship cases for the 4th Judicial Circuit. This division maintains all probate case files and processes document requests. Staff can be reached by phone, email, or in person at the courthouse. The county also has a separate mailing address for the Associate Court division, so check the contact information below if mailing documents.
Holt County was created in 1841 from the Platte Purchase, but probate records date back to 1837 when early settlement records were kept. The county experienced a courthouse fire in February 1965, which destroyed some records. Post-1965 records are well-preserved and available through the clerk's office and Case.net. For pre-1965 records, the Missouri State Archives may hold microfilm copies that can fill in gaps.

How to Search Holt County Probate Court Records
Missouri provides two main ways to access Holt County probate court records: online through Case.net, and in person at the Oregon courthouse. For checking whether a case exists or reviewing basic docket information, Case.net is faster and available any time. For copies of filed documents, the courthouse may be needed depending on when the records were created.
Case.net is Missouri's official statewide court records portal, available at courts.mo.gov/casenet. It holds over 45 million case records going back to the 1980s, with full document access for probate cases filed on or after July 12, 2004. Enter names in the exact format "LAST, FIRST MIDDLE INITIAL." The search is literal, so reversed name order returns no results. Filtering by Holt County helps narrow results for common names. Case.net shows case parties, docket entries, judgments, and scheduled hearings but does not display the full text of filed documents.
Since July 1, 2023, the public can view, download, and print public court records from personal devices including phones, tablets, and computers. Records filed before that date remain viewable only at courthouse terminals in Oregon. For older Holt County probate records, an in-person visit is needed. You can also submit written requests by mail to the Associate Court Division II. Bring a photo ID for in-person visits and a case number or party name to speed up the search.
For Case.net technical support, call the OSCA Help Desk at (888) 541-4894, Monday through Friday, 7:30 AM to 5:00 PM CST.
Note: Case.net does not include sealed, expunged, juvenile, or mental health records. For records lost in the 1965 courthouse fire, check with the Missouri State Archives for any microfilmed copies.
Types of Probate Cases in Holt County
The Holt County Associate Circuit Court, Division II, handles several types of probate cases. Each type produces its own set of records maintained by the division in Oregon.
Estate administration cases are the most common probate matters filed in Holt County. When someone dies with assets in their name, those assets may need to pass through probate before transferring to heirs or beneficiaries. If the decedent left a will, it must be filed with the court. The court appoints a personal representative, sometimes called an executor, to manage and close the estate. Missouri law under Chapter 473 RSMo sets out all required steps, including filing the application for letters, presenting the death certificate and original will, publishing notice to creditors, completing the inventory, and reaching final settlement. Both supervised and independent administration options are available. The creditor claim period runs six months from the date of first publication of notice.
Guardianship and conservatorship cases are also handled in Holt County. A guardianship gives one person legal authority to make personal care decisions for someone unable to do so themselves. A conservatorship covers financial decisions. Both apply to minors and to adults found incapacitated by the court. Under Chapter 475 RSMo, the court must appoint an attorney to represent any adult respondent. Minor guardianship, adult guardianship, and conservatorship are all handled through Division II. A public administrator is also available for cases where no suitable family member or other person is available to serve. Annual reports are required for all active cases.
Will contests and related disputes may also come before the Holt County probate court. Fraud-related claims under Section 472.013 RSMo must be filed within two years of discovering the fraud, with an absolute ten-year limit from the date of the fraudulent act.

Fees for Holt County Probate Court Records
Holt County follows Missouri's standard fee schedule for probate filings and document copies. Filing a full estate administration petition costs approximately $155.50. For smaller estates qualifying for simplified procedures, the filing fee is roughly $65.50 to $75.00.
Standard document copies cost $0.25 per page. Certified copies carry a higher fee. Ask the clerk's office or Division II for the current certified copy rate before mailing your request or visiting the courthouse. Standard certification and copy fees apply to all Holt County probate records, and written requests with appropriate fees can be submitted by mail to the Associate Court Division II mailing address.
Personal representative fees in Missouri are set by statute. Under Section 473.153 RSMo, the allowed fee is 5% of the first $5,000 of estate value, 4% of the next $20,000, 3% of the next $75,000, 2.75% of the next $300,000, 2.5% of the next $600,000, and 2% of amounts over $1 million. These percentages apply to the total value of all assets managed by the personal representative during the administration.
Note: Small estate affidavits for estates under $15,000 do not require creditor publication. Estates between $15,000 and the $40,000 small estate threshold do require publication before assets can be distributed.
Missouri Probate Laws Affecting Holt County Cases
Missouri's probate code spans four chapters of the Revised Statutes. All four apply to every case filed in the Holt County probate court and set out the rules for records, procedures, and public access.
Chapter 472 RSMo covers general probate provisions. It defines key terms, establishes court jurisdiction, and addresses record-keeping standards. Section 472.280 allows probate records to be maintained in formats other than bound volumes, enabling electronic storage. Section 472.013 covers fraud remedies with a two-year discovery window for bringing claims.
Chapter 473 RSMo governs estate administration from initial petition through final settlement. Personal representatives must file annual account statements on the anniversary date of their appointment. Final settlement must happen within six months and ten days of the first publication of creditor notice. This chapter also covers the publication requirements and the steps required before assets can be distributed to heirs or beneficiaries.
Chapter 474 RSMo handles intestate succession, the rules for distributing property when someone dies without a valid will. Spouses and children take priority over more distant relatives. Chapter 475 RSMo covers guardianship and conservatorship, requiring court-appointed attorneys for adult respondents and mandating annual reporting. Estates at or below $40,000 may use the simplified small estate process under Section 473.097 RSMo, available 30 days after the decedent's death.
Public Access to Holt County Probate Records
Missouri Court Operating Rule 2.02 states that records of all courts are presumed open to any member of the public for inspection or copying. Holt County probate records are public records. You do not need to be a party to the case, and you are not required to state why you want access.
There are limits. Sealed cases, expunged records, juvenile records, and mental health records are not available through Case.net or at the courthouse counter. For open records, certain personal data must be removed before documents are shared. Under Missouri redaction rules, anyone filing a document must remove Social Security numbers, driver's license numbers, financial account numbers, dates of birth, names of minors, and other confidential information. The responsibility for redacting belongs to the person who files the document. Courts do not check each document for compliance before accepting them.
Since July 1, 2023, Holt County probate court documents filed on or after that date can be viewed and downloaded from personal devices through Case.net. Older records remain accessible only at courthouse terminals in Oregon. For documents not available remotely, a visit to the Holt County courthouse during business hours, or a written request to the Associate Court Division II, is required.
