How to Search Lewis County Probate Court Records

Two options exist for accessing Lewis County probate records: online through Case.net and in person at the Monticello courthouse. Online access is free and works well for finding basic case information. You need to visit in person to get copies of actual documents.

Case.net at courts.mo.gov/casenet is Missouri's official statewide court portal. It holds over 45 million records, with full probate case availability for cases filed on or after July 12, 2004. Enter names as "LAST, FIRST MIDDLE INITIAL" - the format is exact and literal. Reversing the name order returns no results. Filter by Lewis County when searching common names. The system shows case parties, docket entries, judgment information, and scheduled hearings. It does not display full document text.

Since July 1, 2023, the public can view, download, and print public court documents from personal devices. Documents filed before that date are only accessible at courthouse terminals in Monticello. For older Lewis County records, visit the courthouse during its split hours. Bring a photo ID and the name or case number you are researching.

Types of Probate Cases in Lewis County

The Lewis County Circuit Court handles several types of probate cases. Each creates its own public record maintained by the Circuit Clerk.

Estate administration is the most common type. When someone dies with assets in their name, those assets may need to go through probate before passing to heirs. If a will exists, it must be filed with the court. The court then appoints a personal representative to manage and wind down the estate. Under Chapter 473 RSMo, the representative must give notice to creditors, file annual accounts, and complete the process within six months and ten days of first publication. Creditors have six months from publication to file claims against the estate.

Guardianship and conservatorship cases are handled here as well. A guardianship gives one person authority to make personal and medical decisions for a minor or incapacitated adult. A conservatorship covers financial management. Under Chapter 475 RSMo, the court must appoint an attorney for any adult respondent in these proceedings. Annual reports are required to keep cases active. The Lewis County Public Administrator, Luke Barton at (573) 288-1111, serves cases where no family member is available to act.

Will contests, fraud claims, and disputes over estate administration are also heard by the Lewis County probate court. Fraud claims must be brought within two years of discovering the fraud under Section 472.013 RSMo. Small estates at or below $40,000 may use the simplified affidavit process under Section 473.097 RSMo, starting 30 days after the person's death.

Fees for Lewis County Probate Records

Lewis County uses Missouri's standard statewide fee schedule for probate filings and document copies. These fees apply across all circuits in the state.

The filing fee for a full estate administration petition is approximately $155.50. Estates qualifying for the simplified small estate process pay roughly $65.50 to $75.00. Always confirm the current fee with the clerk's office before filing, as amounts can change.

Document copies cost $0.25 per page. Certified copies require an additional fee beyond the per-page rate. If you need certified copies of estate documents for use in another proceeding, ask the clerk's office for the current certified copy charge when you call or visit in Monticello.

Personal representative compensation is governed by Section 473.153 RSMo. The allowed fee is 5% of the first $5,000, 4% of the next $20,000, 3% of the next $75,000, 2.75% of the next $300,000, 2.5% of the next $600,000, and 2% of anything over $1 million. These percentages apply to total assets under the representative's management.

Small estates under $15,000 do not require publication. Estates between $15,000 and $40,000 require it, which adds a publication cost to the process.

Missouri Probate Laws That Apply to Lewis County

Every probate case in Lewis County is subject to Missouri's Revised Statutes, Chapters 472 through 475. These statutes govern the process from the initial filing through final closing and distribution.

Chapter 472 RSMo covers general probate provisions. It defines key terms, sets court jurisdiction and venue, and allows electronic record keeping under Section 472.280. Section 472.013 provides remedies when fraud has occurred in a probate proceeding, with a two-year deadline from discovery.

Chapter 473 RSMo governs estate administration. Personal representatives must file accounts on the anniversary of their appointment each year the estate remains open.

Chapter 474 RSMo addresses intestate succession. When a person dies without a will, this chapter determines which heirs inherit and in what order. Spouses and children take priority, followed by more distant relatives under the statutory priority order.

Chapter 475 RSMo governs guardianship and conservatorship cases. It requires attorney appointments for adult respondents and annual reporting for ongoing matters. The simplified small estate process under Section 473.097 RSMo is available for estates at or below $40,000, starting 30 days after the person's death.

Public Access to Lewis County Probate Records

Missouri Court Operating Rule 2.02 establishes that court records are presumed open to any member of the public for inspection and copying. Lewis County probate records are public records. You do not need to be a party to the case. No reason is required to access open records.

Some records are not public. Sealed cases, expunged files, juvenile records, and mental health proceedings are not accessible through Case.net or at the courthouse counter. For open records, anyone who files a document must redact confidential information before submitting it.
