Which County Handles Joplin Probate Cases

Joplin spans Jasper and Newton counties, but the primary jurisdiction for most of the city is Jasper County. Jasper County is unusual in Missouri because it has two county seats, Carthage and Joplin, and the 29th Judicial Circuit maintains full court operations at both locations. There are no jurisdictional lines between the two courthouses. Cases can be filed at either location.

This is a significant convenience for Joplin residents. The Jasper County Courts Building at 601 S. Pearl Ave. in Joplin is a fully functional circuit court location. Probate filings, records requests, and in-person case reviews can all be handled there. The main Probate Division office and probate clerk are based in Carthage, but Joplin handles day-to-day probate needs as well.

Joplin also has a municipal court at 303 E. 3rd St., phone (417) 624-0820 ext. 5300, with information at joplinmo.org/513/Municipal-Court. That court handles city ordinance and traffic violations only. Estate cases and guardianship matters go to the Jasper County circuit court locations.

Types of Probate Cases Filed in Joplin

The Jasper County probate division handles the full range of probate cases for Joplin residents. Cases can be filed at either the Joplin or Carthage courthouse with no difference in outcome.

Estate administration is the most common matter. When a Joplin resident dies with assets in their name, the estate may require court involvement to transfer property. Wills must be filed with the probate division. A personal representative is appointed to manage the estate under Chapter 473 RSMo. Creditors have six months from the first notice publication to file claims. Final settlement follows after the creditor period closes.

Small estates at $40,000 or less (after liens and encumbrances) can use the simplified procedure in Section 473.097 RSMo. Heirs can file a small estate affidavit starting 30 days after the death. This process is faster and less expensive than full estate administration. Publication is required if the estate exceeds $15,000.

Guardianship and conservatorship cases protect minors and incapacitated adults in Joplin. A guardianship grants authority over personal decisions; a conservatorship covers financial management. Chapter 475 RSMo requires the court to appoint an attorney for adult respondents. Annual reports are required to keep these cases active in Jasper County. Jasper County also offers Veterans Court and treatment court programs, though those are separate from the standard probate division.
